Letters

From our experience, letters often don’t get taken seriously (or sometimes even opened) if it doesn’t come from a lawyer. Sometimes a powerful letter coming from a serious lawyer is all you need to get things going in the right direction.

We draft all sorts of letters depending on your specific situation. For example, employment termination letters, promissory notes, formal complaint letters and more.

Cease and Desist Letter

A Cease and Desist Letter is a written legal notice that demands the recipient to stop a specified behavior or activity that is violating the sender’s rights.

They are typically sent to address various issues such as:

  • Intellectual property infringement: If someone is using your copyrighted material, trademark or intellectual property without your permission.
  • Breach of contract: When the other party is in breach and you want them to stop violating the terms of your agreement.
  • Defamation: In cases of defamation or spreading false information about you or your business.

“Why should I send a cease and desist letter?”

Having your lawyer send a Cease and Desist Letter serves as a formal and documented warning. It demonstrates your intention to take legal action if the recipient fails to comply. Often, it provides an opportunity to resolve the issues without going to court. However if the matter does go to court, this letter could back your case by serving as an important piece of evidence.

A good Cease and Desist Letter clearly identifies the specific actions that are violating the sender’s legal rights or obligations. They also provide a specific legal basis to ground the sender’s claims. This serves as a viable foundation for potential legal action. It’s always clear when a sender is using a free template. Cease and Desist Letters should be drafted by a lawyer in order to be taken seriously by the recipient.

Legal Warning and
Demand Letter

A Legal Warning and Demand Letter is a formal letter that demands the other party to perform a legal obligation. The letter describes the agreement between parties and gives the recipient a chance to fix the issue without being taken to court.

They are typically sent to address various issues such as:

  • Collecting a debt: If someone owes you money, sending a Demand Letter will prompt them to pay the outstanding debt.
  • Breach of contract: When the other party is in breach and you want them to perform an obligation.

An effective Legal Warning and Demand Letter clearly details the actions that the sender expects from the recipient. They also provide a specific legal basis to ground the sender’s claims. These letters should be sent by a lawyer in order to be taken seriously by the recipient.
